Driver Terms of service & Privacy Policy

Brighton Taxi 4U Ltd. also doing business as TAXI 4U collects information about you when you use our mobile applications, websites, and other online products and services (“Services”) and through other interactions and communications you have with us.

Scope and Application

This Privacy Policy applies to drivers, couriers, partner transportation companies, and any other persons that use the TAXI 4U platform under license (“Drivers,” or individually “you”).

Collecting Information:

 

Information You Provide to Us

We collect information you provide directly to us, such as when you create, modify, or log in to your account, request support from us, consent to a background check, submit your driver’s license, submit information about your vehicle or insurance, or otherwise communicate with us. This information may include: name, email, phone number, postal address, App profile picture, payment information, vehicle registration information, insurance information, driver’s license information, and other information you may choose to provide.

Information We Collect Through Your Use of Our Services

When you use our Services, we collect information about you in the following general categories:

  • Location Information: As a condition of providing Users with transportation, delivery, or other services via the TAXI 4U platform, your precise location data must be provided to TAXI 4U via the Application that you use. Once the TAXI 4U Application has permission to access location services through the permission system used by your mobile operating system (“platform”), we will collect the precise location of your device when the Application is running in the foreground or background. We may also derive your approximate location from your IP address.
  • Contacts Information: If you permit the TAXI 4U Application to access the address book on your device via the permission system used by your platform, we may access and store names and contact information from your address book to facilitate social interactions through our Services and for other purposes described in this Policy or at the time of consent or collection.
  • Transaction Information: We collect transaction details related to the transportation (or other) services you provide through our platform, including the type of service provided, date and time the service was provided, amount charged, distance travelled, and other related transaction details. Additionally, if someone uses your promo code, we may associate your name with that person.
  • Usage and Preference Information: We collect information about how you and site visitors interact with our Services, preferences expressed, and settings chosen. In some cases, we do this through the use of cookies, pixel tags, and similar technologies that create and maintain unique identifiers.
  • Device Information: We may collect information about your mobile device (whether your own device or a device we provide to you), including, for example, the hardware model, operating system and version, software and file names and versions, preferred language, unique device identifier, advertising identifiers, serial number, device motion information, and mobile network information.
  • Call and SMS Data: Our Services facilitate communications between Users and Drivers. In connection with facilitating this service, we receive call data, including the date and time of the call or SMS message, the parties’ phone numbers, and the content of the SMS message.
  • Log Information: When you interact with the Services, we collect server logs, which may include information like device IP address, access dates and times, app features or pages viewed, app crashes and other system activity, type of browser, and the third-party site or service you were using before interacting with our Services.

Important Information About Platform Permissions

Most mobile platforms (iOS, Android, etc.) have defined certain types of device data that apps cannot access without your consent. And these platforms have different permission systems for obtaining your consent. The iOS platform will alert you the first time the TAXI 4U Application wants permission to access certain types of data and will let you consent (or not consent) to that request. Android devices will notify you of the permissions that the TAXI 4U Application seeks before you first use the Application, and your use of the Application constitutes your consent.  We will be acting as an agent for you as a selfemployed driver this will include:

  • Relay bookings to you (usually on a rota basis) for an agreed fee.
  • Collect fares on your behalf from account customers.
  • You will be entitled to the full fares paid by the customers, alsoTAXI 4U as an agent will deducted fees from the account fares.

Information We Collect from Other Sources

We may also receive information from other sources and combine that with information we collect through our Services. For example:

  • If you choose to link, create, or log in to your TAXI 4U account with a payment provider or social media service (e.g., Facebook), or if you engage with a separate app or website that uses our API (or whose API we use), we may receive information about you or your connections from that site or app.
  •  you also interact with our Services in another capacity, for instance to request on demand services as a User, or as a user of other apps we may provide, we may combine or associate that information with information we have collected from you in your capacity as a Driver.

Use of Information

We may use the information we collect about you to:

  • Provide, maintain, and improve our Services, including, for example, to facilitate payments, send receipts, provide products and services you request (and send related information), develop new features, provide customer support to Users and Drivers, develop safety features, authenticate users, and send product updates and administrative messages;
  • Perform internal operations, including, for example, to prevent fraud and abuse of our Services; to troubleshoot software bugs and operational problems; to conduct data analysis, testing, and research; and to monitor and analyse usage and activity trends;
  • Send or facilitate communications (i) between you and a User (e.g. a rider), such as estimated times of arrival (ETAs), or (ii) between you and a contact of yours at your direction in connection with your use of certain features, such as referrals.
  • Send you communications we think will be of interest to you, including information about products, services, promotions, news, and events of TAXI 4U and other companies, where permissible and according to local applicable laws; and to process contest, sweepstake, or other promotion entries and fulfil any related awards;
  • Personalize and improve the Services, including to provide or recommend features, content, social connections, referrals, and advertisements.
  • You are not allowed to share, miss use or expose users details with anyone else.

We may transfer the information described in this Policy to, and process and store it in, Canada, the United States and other countries, some of which may have less protective data protection laws than the region in which you reside. Where this is the case, we will take appropriate measures to protect your personal information in accordance with this Policy.

Sharing of Information

We may share the information we collect about you as described in this Policy or as described at the time of collection or sharing, including as follows:

Through Our Services

We may share your information:

  • With Users in connection with their request for transportation or other services. For instance, we may share your name, personal photo, vehicle photo, vehicle license, vehicle make and model, precise or approximate location, average rating provided by Users, and certain contact information (depending upon your location and applicable laws). After you have provided the requested services, we will send the User a receipt via e-mail or other means which may include the breakdown of amounts charged, your name, contact information, photo, a map of the route you took, and other transaction details.
  • With other people, as directed by you, in connection with a particular service, offering or promotion; or with third parties to provide you a service you requested through a partnership or promotional offering made by a third party or us;
  • With the general public if you submit content in a public forum, such as blog comments, social media posts, or other features of our Services that are viewable by the general public;
  • With third parties with whom you choose to let us share information, for example other apps or websites that integrate with our API or Services, or those with an API or Service with which we integrate; and
  • With your partner transportation company and any necessary third parties engaged by us or the partner company, if you use the Services through an account connected to a partner transportation company.

Other Important Sharing

We may share your information:

  • With TAXI 4U subsidiaries and affiliated entities that provide services or conduct data processing on our behalf, or for data centralization and / or logistics purposes;
  • With vendors, consultants, marketing partners, and other service providers who need access to such information to carry out work on our behalf;
  • In response to a request for information by a competent authority if we believe disclosure is in accordance with, or is otherwise required by, any applicable law, regulation, or legal process;
  • With law enforcement officials, government authorities, or other third parties if we believe your actions are inconsistent with our User agreements, Terms of Service, or policies, or to protect the rights, property, or safety of TAXI 4U or others;
  • In connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company;
  • If we otherwise notify you and you consent to the sharing; and
  • In an aggregated and/or anonymized form which cannot reasonably be used to identify you.

Social Sharing Features

The Services may integrate with social sharing features and other related tools which let you share actions you take on our Services with other apps, sites, or media, and vice versa. Your use of such features enables the sharing of information with your friends or the public, depending on the settings you establish with the social sharing service. Please refer to the privacy policies of those social sharing services for more information about how they handle the data you provide to or share through them.

Analytics and Advertising Services Provided by Others

We may allow others to provide audience measurement and analytics services for TAXI 4U, to serve advertisements on our behalf across the Internet, and to track and report on the performance of those advertisements. These entities may use cookies, web beacons, “Software Development Kits” (“SDKs”), and other technologies to identify your device when you visit our site and use our Services.

User Choices

Account Information

You may correct your account information at any time by logging into your online or in-app account. If you wish to cancel your account, please email us at Admin@taxi-4u.co.uk Please note that in some cases we may retain certain information about you as required by law, or for legitimate business purposes to the extent permitted by law. For instance, if you have a standing credit or debt on your account, or if we believe you have committed fraud or violated our Terms, we may seek to resolve the issue before deleting your information.

Access Rights

TAXI 4U will comply with individual’s requests regarding access, correction, and/or deletion of the personal data it stores in accordance with applicable law.

Location Information

We request permission for our Application’s collection of precise location from your device (whether your own device or one we provide) per the permission system used by your mobile operating system. If you initially permit the collection of this information, you can later disable it by changing the location settings on your mobile device. However, you will not be able to provide services on the TAXI 4U platform if you disable our collection of precise location data. Additionally, disabling our collection of precise location from your device will not limit our ability to derive approximate location from your IP address.

Promotional Communications

You may opt out of receiving promotional messages from TAXI 4U by following the instructions in those messages. If you opt out, we may still send you non-promotional communications, such as those about your account, about Services you have requested, or our ongoing business relations.

Cookies and Advertising

TAXI 4U and our affiliates, third parties, and other partners use cookies and other identification technologies on our Services for several purposes, including: authenticating users, remembering user preferences and settings, determining the popularity of content, delivering and measuring the effectiveness of advertising campaigns, analysing site traffic and trends, and generally understanding the online behaviours and interests of people who interact with our Services.

Cookies are small text files that are stored on your browser or device by websites, apps, online media, and advertisements. There are different types of cookies. Cookies served by the entity that operates the domain you are visiting are called “first party cookies.” So, cookies served by TAXI 4U while you are on www.taxi-4u.co.uk are first party cookies. Cookies served by companies that are not operating the domain you are visiting are called “third party cookies.” So, we may allow Google to set a cookie on your browser while you visit www.taxi-4u.co.uk, and that would be a third-party cookie. Cookies may also endure for different periods of time. “Session Cookies” last only as long as your browser is open. These are deleted automatically once you close your browser. Other cookies are “persistent cookies” meaning that they survive after your browser is closed. For example, they may recognize your device when you re-open your browser and browse the Internet again.

Other identification technologies we may use or permit on our Services may include “Pixel tags” (also called beacons or pixels), which are small blocks of code installed on (or called by) a webpage, app, or advertisement which can retrieve certain information about your device and browser, including for example: device type, operating system, browser type and version, website visited, time of visit, referring website, IP address, and other similar information, including the small text file (the cookie) that uniquely identifies the device. Pixels provide the means by which third parties can set and read browser cookies from a domain that they do not themselves operate and collect information about visitors to that domain, typically with the permission of the domain owner. “Local storage” refers generally to other places on a browser or device where information can be stored by websites, ads, or third parties (such as HTML5 local storage and browser cache). SDKs function like pixels and cookies but operate in the mobile app context where pixels and cookies cannot always function. The primary app developer can install pieces of code (the SDK) from partners in the app, and thereby allow the partner to collect certain information about user interaction with the app and information about the user device and network information.

Terms of service

  1. The holder of a private hire or Hackney driver’s licence (“the driver”) shall comply with the following conditions.
  2. The driver shall be respectably dressed and clean and tidy in appearance.
  3. The driver shall not allow the badge granted to him to be used by any other person or cause or permit any other person to wear it and on termination or surrender of the driver’s licence, shall return the badge to the Authority immediately.
  4. The driver shall behave in a civil, polite and orderly manner at all times in the course of carrying out business and shall take all reasonable precautions to ensure the safety of persons conveyed in or entering or alighting from the vehicle.
  5. The driver shall not wilfully or negligently cause or permit the vehicle licence plates to be concealed from public view.
  6. Driver shall not share or expose customer’s details.
  7. The driver who has agreed or has been hired to be in attendance with the vehicle at an appointed time and place shall, unless delayed or prevented by some sufficient cause, punctually attend with such vehicle at such appointed time and place.
  8. The driver when hired to drive to a particular destination shall, subject to any directions given by the hirer, proceed to that destination by the shortest route if possible.
  9. The driver shall not convey or permit to be conveyed in such vehicle any number of persons greater than the number of persons specified in the licence and also referred to on the vehicle licence plate.
  10. The driver shall convey a reasonable amount of luggage and provide reasonable assistance in loading and unloading luggage.
  11. The Private hire driver shall not PLY FOR HIRE or accept any booking, which is not made via operator. solicit, by calling out or otherwise importune, any person to hire or be carried for hire, and shall not accept an offer for the hire of the vehicle except where that is first communicated to the driver by the operator (App) otherwise it is a Hackney Vehicle.
  12. The vehicle shall be presented in a clean and tidy condition for each journey.
  13. The vehicle shall only be driven by licensed private hire or Hackney drivers who have the consent of the proprietor of the vehicle.
  14. The driver shall comply with any hirer’s request not to drink, smoke or eat in the vehicle,
  15. Not without the express consent of your passenger(s) play any radio or sound producing instrument or equipment in the vehicle other than for the purpose of sending or receiving messages in connection with the operation of the vehicle.
  16. The driver shall not operate the horn as a means of signalling that the vehicle has arrived for a hire.
  17. DOCUMENTATION TO BE MAINTAINED FOR VEHICLES USED: You must ensure that prior to driving any private hire vehicle you are in possession of the following:

a) A current Mot Certificate for the vehicle (issued by a testing centre approved by the Licensing Office).

b) A current insurance certificate, policy of insurance or cover note covering your use of the vehicle for Hackney or private hire. If there are exceptional reasons which prevent you from maintaining or ensuring "continuous" insurance cover for the private hire vehicle you use, FOR WHATEVER REASON, throughout the duration of the time you are in possession of it, you must attend and notify the Licensing Office and Taxi 4U, in writing, within 3 days following the insurance cover expiring or lapsing.

 

18. All Hackney vehicles operating in their cities should be fitted with a taximeter, then the driver of Holder the vehicle shall unless they are going out of town use their meters or the fares as set       by the local Authority.

19. Have a good standard of personal hygiene, be clean and respectable in your appearance and behave in a civil and orderly manner at all times whilst your vehicle is in use or available for hire.

20. Ensure that when booked, you are in attendance with the vehicle at the appointed time and place unless delayed or prevented by some sufficient cause.

21. Take all reasonable steps to assist with and ensure the safety of your passenger(s) when entering, being conveyed in and alighting from your vehicle. h) Unless otherwise directed by your passenger(s), proceed to the destination by the shortest possible route.

22. Not demand a fare in excess of any previously agreed for that hiring or what is shown on the App. you must not demand a fare in excess of  that shown on Taxi 4U app, If you are Hackney operating in your licenced area You must use your fitted meter, unless your are hackney and operating outside your licenced area.

 

ASSISTANCE DOGS & WHEELCHAIR USERS

  1.  You must not refuse to accept the hiring of a vehicle merely because the passenger is accompanied by a guide dog or assistance dog. If you have a medical exemption from carrying dogs, then this must be obtained in writing from the Licensing Office and be maintained in the vehicle at all times for production to passengers or inspection by an authorised officer.
  2.  You must not make any additional charge for the carriage of a guide or assistance dog, the conveyance of a wheelchair, or other equipment required by a person suffering from a disability.

The Equality Act 2010: brings together several existing laws into one place so that it is easier to use. It sets out the personal characteristics that are protected by the law and the behaviour that is unlawful. Under the Act people are not allowed to discriminate, harass or victimise another person because they have any of the protected characteristics including disability. The act gives examples of unacceptable behaviour whilst the Equality Commission web site www.equalityhumanrights.com) gives examples of best practice.

Smoke Free Legislation: Private Hire Vehicles and ‘Taxis’ are smoke free vehicles, and nobody may smoke within these vehicles. Appropriate ‘No Smoking’ signage must be displayed in the vehicle. Furthermore, any enclosed premise that is used as a workplace or is used by the public, for example, making bookings, must be smoke-free. Failing to prevent smoking in a smoke free place can lead to prosecution and a maximum fine of £2,500 being imposed on whoever manages or controls the smoke-free premises or vehicle. Changes to The Policy: TAXI 4U may change this Policy from time to time. If we make significant changes in the way we treat your personal information, or to the Policy, we will provide you notice through the Services or by some other means, such as email. Your continued use of the Services after such notice constitutes your consent to the changes. We encourage you to periodically review the Policy for the latest information on our privacy practices.
